If you decide to move forward with your case, we’ll never ask you for a dime. That’s because the federal overtime law mandates that the employer that violated the law pay our fees. And we’ll advance the courts costs associated with your case.
Often, once we’ve notified the employer, the employer offers to settle before a court case is ever filed. If we do file a lawsuit on your behalf, the employer will usually offer to settle before the first court appearance. We will give you all of the details so that you can make an informed decision about whether to settle or to press on. Remember, we will be at your side every step of the way.
When a settlement is reached or the court arrives at a decision in your favor, the employer sends us a check that includes your money, court costs, and our fee. We, in turn, send you a check for the amount of the settlement or judgment.
The nagging question remains…. What if your employer fires you in retaliation? That could happen, but the law specifically addresses this issue, and prohibits employers from penalizing employees who assert their rights. If your employer in any way punishes you, you can sue under the FLSA for retaliation. Jury awards in retaliation suits can range from tens of thousands to millions of dollars. And we’ll still be at your side.
