My boss says I don’t get overtime because I’m a manager, but I’m only a manager because I close the shop at night. Is my boss right?
Probably not. The law says that employees aren’t exempt from overtime pay because of their job title, but because of their job duties. To be exempt from overtime, the employee is responsible for things like supervising others, setting policy, or deciding who is hired and fired.
How much will you charge to represent me?
Lemberg Law won’t charge you a dime. The Fair Labor Standards Act says that employers who violate the law have to pay the legal expenses and court costs of employees who sue. In other words, we only get paid when we win, and when we win, the employer pays our fees.
Is there a deadline for suing my employer for overtime pay?
Yes. You have two years to file a legal complaint in court for back pay, or three years if the employer knowingly and willfully violated the law. It’s important not to let the clock run out, and to begin building your case as soon as possible after the violation.
If I sue my employer for overtime pay, won’t I get fired?
It’s understandable that you’re nervous about retaliation by your employer. If your employer fires you, transfers you, denies you a promotion, or punishes you in some other way for asserting your rights, the Fair Labor Standards Act protects you.
